Through innovation and creativity, sound advancements in science and technology, and efficient programs that improve economic vitality and environmental sustainability, we build a stronger California.

The Legal Affairs Office provides CalRecycle staff with support on legal history, actions, analysis, and advice. The office supervises all litigation and other legal actions entered into by the department. The Legal Affairs Office provides legal services necessary to implement the programs mandated by The California Integrated Waste Management Act of 1989 (AB 939, Sher, Chapter 1095, Statutes of 1989) and subsequent statutes related to integrated waste management as well as the Beverage Container Recycling and Litter Reduction Act (AB 2020, Margolin, Chapter 1290, Statutes of 1986) and subsequent statutes related to recycling.

The Legal Affairs Office advises regarding legal requirements related to development and adoption of regulations, including requirements of the Administrative Procedure Act and procedures of the Office of Administrative Law. Reviews contracts entered into by CalRecycle and advises staff regarding contract requirements and procedures when necessary. Advises on conflict of interest, incompatible activities, and public records request laws. With the Attorney General, represents CalRecyde in litigation brought on behalf of or against the department.

CalRecyde has the authority to take enforcement action independent of the local enforcement agencies. Through the Attorney General's office. CalRecycle may pursue both civil and criminal penalties for violations of State standards for recycling facilities. Represents CalRecycle in both formal and informal administrative hearings concerning the Beverage Container Recycling and Litter Reduction Act. Responds to legal inquiries from the CalEPA, other State control agencies, and affected parties regarding responsibilities and authority of CalRecycle as well as Beverage Container Recycling Act and regulations.

Job Description And Duties

T his position is located in the Office of Legal Affairs. The Office of Legal Affairs provides legal guidance, representation, and services designed to support the organization with decision-making and mitigation of legal risk. Under general direction of the Assistant Chief Counsel and/or an attorney who shall accept full responsibility for the tasks performed, the Legal Analyst investigates and analyzes facts and documents in connection with administrative and civil litigation; assists in hearing preparation by coordinating witnesses and processing subpoenas; coordinates with opposing counsel, hearing officers, Administrative Law Judges and others, such as vendors, relative to ministerial problems; when delegated by the attorney, drafts interrogatories and responses to interrogatories; interviews witnesses, complainants, and defendants concerning the facts of cases; drafts roughs of pleadings, complaints, and motions for attorney review by the attorney; assists in the preparation of witness books and exhibit books; conducts historical research with regard to cases and by summarizing deposition transcripts; assists in administrative proceedings by preparing drafts of accusations and statements of issues; prepares responses to routine procedural and/or large volume type inquiries; prepares legislative histories and follow up on legislative and regulatory files.

We are looking for someone with strong research and analytical skills. The Legal Analyst must also be a strong communicator with tact and professionalism. To be successful in this position you will need to work cohesively with a team, and be open minded and flexible to new ideas and solutions.

This position may be eligible for hybrid telework under Government Code 14200 for eligible applicants residing in California, subject to the candidate meeting telework eligibility criteria set forth in the CalEPA telework policy and/or future program need. Employees not residing in California are not eligible for telework. Regardless of telework eligibility, all employees may be required to report to the position’s designated headquarters location, as indicated on their duty statement, at their own expense.
