PURPOSE OF CONSULTANCY
A PAHO Consultant may be engaged on a full-time or part-time basis for the purpose of performing a specific time-limited piece of work for PAHO in a technical advisory capacity or consultative capacity. Examples of the type of work for which a consultant contract should normally be issued are: analysis and advice on public health, medical, scientific or other health and related technical issues in countries, including the analysis of the national health situation, evaluation of national health programs, the establishment of local alliances and networks; direct technical assistance to address a particular health issue in countries (including disease outbreaks, response to emergencies, specialized training, research, development of policies, norms and protocols, etc.
Internationally-hired consultant: An internationally-hired consultant is a person who is not living or residing in the country and who has been hired from outside the country where the work is to be performed. The work performed by internationally-hired consultants is regional or subregional in scope (not country specific). An international consultant will normally be hired for periods not exceeding a continuous duration of up to one (1) year, renewable for a second period of up to one (1) year, for the same tasks as described in the ToRs, within the same work plan and/or project. Upon completion of a series of continuous contracts that equal 24 months in duration.
Pay Band D-Maximum level is to be used only in exceptional circumstances when a senior expert with extensive experience (minimum 15 years) and expertise is required at a level normally equivalent to the D.2 level.
Hiring managers will be responsible for reviewing the consultant contract and for ensuring that: the services to be rendered match the criteria of the type of services to be provided by the consultant pursuant to the Consultant Policy; and that decisions on contracting and all other matters of substance are taken in accordance with policy provisions.
DESCRIPTION OF DUTIES:
The Investigations Office (INV) was established on 1 January 2018. INV plays a key role in fostering good governance of the Organization by conducting administrative fact-finding investigations into allegations of wrongdoing involving the Pan American Sanitary Bureau (PASB) personnel or third parties who perform services or activities contracted or financed by the Pan American Health Organization (PAHO). Findings and conclusions issued by INV provide management with a factual basis upon which to make informed decisions and take appropriate action, disciplinary or otherwise.
Through the Preamble to the "Uniform Principles and Guidelines for Investigations" (2nd Edition - 2009) the Conference of International Investigators acknowledges the need for Investigative Offices to periodically undergo an external quality assessment to ascertain their conformity with the Organization's legal framework and generally accepted investigation standards and to promote continuous enhancement of the investigation function. Accordingly, INV is seeking to conduct an external review of its investigation practices in the latter half of 2024.
For the purposes of the review, INV will engage an Expert to undertake INV's review in accordance with the terms specified in the Terms of Reference. The Expert will be part of a peer review panel and work with other panel member(s) to conduct the review.
Duties and Responsibilities
The Expert, together with other members of the peer review panel, will undertake the Review by:
Assessing applicable institutional, policy and procedural documentation and reports. These should include the Terms of Reference of INV, relevant policies and procedures, such as the Investigations Protocol, and other documentation pertinent to the investigation function in PAHO.
Interviewing personnel, including, where possible: (i) staff at all levels of the investigative functions; (ii) member(s) of the Audit Committee; (iii) member(s) of Executive Management; and (iv) other relevant actors, including offices interacting with INV on investigative matters or receiving and/or acting upon investigation reports.
In accordance with PAHO's policies and procedures, and observing applicable confidentiality and data protection requirements, the reviewers may examine a sample of closed investigation case files from the previous five years with a view to assessing the application of relevant standards / guidelines based upon the evidentiary materials within the files. The cases should be representative of the caseload and mandate of INV.
Benchmarking with best practices as applied by similar offices, considering relevant Administrative Tribunal of the International Labour Organization (ILOAT) and other jurisprudence.
Reviewing other documents deemed relevant by the reviewers, including recent typical cases that resulted in sanctions.
Producing case statistics and other relevant data pertaining to the use and efficiency of INV Processes (subject to certain limitations on the scope of available case data for reasons of confidentiality);
After discussion with relevant stakeholders, including INV, make recommendations on actions or modifications to the INV regulatory framework that the INV can add to improve the efficiency and effectiveness of the INV processes.
Expected Outcomes:
The Expert will conduct the Review in accordance with the methodology agreed with INV. Methodology. The Expert will prepare a draft of Methodology, identifying the strategies used to deliver the expected results. The final Methodology will be agreed with INV.
Desk review. Reviewing the regulatory framework applicable to INV's administrative review and Staff Regulations, in accordance with PAHO's policies and procedures;
Reviewing the regulatory framework applicable to INV's investigative and disciplinary process;
Identifying and reviewing data pertaining to the use and efficiency of INV's administrative review (subject to certain limitations on the scope of available case data for reasons of confidentiality) and, on those grounds, producing statistics and identifying trends that may support recommendations for specific improvements;
Personnel consultation and information collection. Identifying key staff members and preparing survey questionnaires for consultation and interviews on the interpretation and application of INV's Processes, including its strengths, potential gaps and areas for improvement.
Comparative review. Prepare survey questionnaires and establish contact with relevant INV departments and offices.
Reporting. Upon conclusion of the review, the Expert will provide to the INV:
(i) A draft Report with the review results and recommendations as described in paragraph d. above;
(ii) An Annex with data, statistics, review results and all information collected/produced during the review process; and
(iii) A Final Report. The Expert will review and finalize the final Report and recommendations and submit it to the INV.
Term and Duration: Contract duration is for approximately two months with an expected start date in September 2024.
The daily rates range for Band D is US$ 491 - US$ 561.
ADDITIONAL INFORMATION This vacancy notice may be used to identify candidates for other similar consultancies at the same level.

PAHO/WHO shall have no responsibility whatsoever for any taxes, duties, social security contributions or other contributions payable by the Consultant. The Consultant shall be solely responsible for withholding and paying any taxes, duties, social security contributions and any other contributions which are applicable to the Consultant in each location/jurisdiction in which the work hereunder is performed, and the Consultant shall not be entitled to any reimbursement thereof by PAHO/WHO.
