The Attorney 4 will be expected to provide a full range of legal services to the Board of Commissioners of the Port of New Orleans (the “Board”). The Attorney 4 will report to the General Counsel. This role will be responsible for handling matters involving multiple specialized areas of law, including but not limited to Louisiana property law, state and federal public bid and procurement laws, Louisiana ethics law, the General Maritime Law of the United States, the Jones Act, state and federal employment laws, state and federal contract laws and other general advices applicable to public entities. Additionally, due to the Board’s legislative affiliation with the New Orleans Public Belt Railroad for the Port of New Orleans (“NOPB”), the Attorney 4 will be required to provide legal services and advices in matters that may also involve the Federal Employers Liability Act (“FELA”), the Federal Railroad Safety Act (“FRSA”) and other rules and regulations of the Federal Railroad Administration (“FRA”), as well as labor disputes, time claims and disciplinary matters involving varying crafts and multiple collectively-bargained union agreements.

Minimum Qualifications

MINIMUM QUALIFICATIONS:

Possession of a license to practice law in the state of Louisiana, plus four years of experience as a practicing attorney.

Job Concepts

To serve as a senior attorney in a legal unit and serve as a specialist of the most complex law areas.

Supervision Received:

Broad review from an Attorney--Deputy General Counsel 1 or equivalent/higher ranking attorney, administrative law judge, or other agency administrator/executive. Note: Attorney 4's should not report to an Attorney Supervisor.

Supervision Exercised:

May supervise a lower ranking attorney or administrative law judge.

Location of Work:

May be used by all agencies.

Job Distinctions:

Differs from other Attorney jobs by the level of independence exercised, supervision received, supervision exercised, and the complexity of the specialized programmatic areas or hearings conducted. The Attorney 4 is intended to be a specialist level. Not all staff level positions will be allocated to the Attorney 4 job.

Differs from Deputy General Counsel 1 by subordinate relationship.

Examples of Work

70% LITIGATION/CORPORATE DUTIES:

+ Prepare pleadings, briefs and other legal documents for the Port and NOPB, and otherwise represent both entities in complex and important litigation before trial, bankruptcy and appellate courts and administrative tribunals, mediation and settlement negotiations and regulatory bodies on matters such as Jones Act claims and other maritime personal injury, FELA claims, bridge accidents, wharf damage and other marine casualties, worker compensation, civil service appeals, unemployment compensation claims, disciplinary hearings and other employment-related matters, collection and bankruptcy matters, real estate evictions, sequestrations, sheriff's sales, mandamus proceedings, labor disputes and other legal matters;

+ Advise the Port's and NOPB’s senior management, Executive Counsel and General Counsel regarding legal issues involving Port and NOPB policies, public contracts law, public records law, open meetings law and other complex legal questions affecting the daily operations of the entities;

+ Manage and monitor efforts of outside counsel engaged on the Port’s or NOPB’s behalf in litigation;

+ Advise and provide legal support the Port’s and NOPB’s claims personnel in the investigation, administration and disposition of casualty claims;

+ Advise the Port’s and NOPB’s Human Resources personnel and other directors and officials regarding the application of organizational policies and procedures and provide legal guidance in the preparation of manuals and policies governing such procedures and operations of the entities;

+ Provide legal advices to the Port’s and NOPB’s Human Resources personnel and other directors regarding personnel, disciplinary and similar matters;

+ Advise on the applicability of the public records law and provide advices and support on behalf of the legal department regarding the final review and production of documents responsive to public records requests in coordination with the custodian of records;

+ Review and comment on pending legislation and drafts; draft, review and analyze new legislation which may affect the Port and NOPB; recommend, respond to and report to the Port's and NOPB’s senior executive staff on the need for additional legislation to accomplish the Port’s and NOPB's mission and objectives;

+ Assist in the analysis and review of FMC matters to determine the applicability of or need for revisions to the Port's Tariff governing Port operations; and

30% TRANSACTIONAL/OTHER DUTIES:

+ Draft, review and revise leases, servitudes, permits, contracts, bidding packages, requests for proposals, ordinances and other legal documents for Port and NOPB;

+ Other duties as directed. Must possess and maintain a Notarial Commission.
